FIXD Privacy Policy

We believe that transparency is the key to any healthy relationship. At FIXD, we’re all about helping you keep your vehicle healthy. We appreciate that you are trusting us with information that is important to you, and we want to be transparent about how we use it.

Here we describe the privacy practices for our FIXD devices, applications, and websites.  You will learn about the data we collect, how we use it, the controls we give you over your information, and the measures we take to keep it safe.

Information We Collect

When you use our Services, we collect the following types of information.

Information You Provide Us

Account Information

Some information is required to create an account on our Services, such as your name, email address, password, and in some cases your mobile telephone number. This is the only information you have to provide to create an account with us. We use the information we collect to improve and personalize the Services and to develop new ones, to identify you on the service, as well as to contact you through use of the Service, such as responding to password reset requests. You may also choose to provide other types of information, such as where you identify on the DIFM (‘Do It For Me’) and DIY (‘Do It Yourself’) spectrum, which allows us to change the information we present to you within the app to be better tailored to you.

Vehicle Information

To help improve your experience or enable certain features of the FIXD app, you may choose to provide us with additional information particular to your vehicle, such as Vehicle Identification Numbers (VINs), manufacturer, model, engine type, and mileage.

Additional Information

If you contact us or participate in a survey, contest, or promotion, we collect the information you submit such as your name, contact information, and message.

Information From Third-Party Sources

If you choose to connect your account on our Services to your account on another service, we may receive information from the other service. For example, if you connect to Facebook, we may receive information like your name, age range, language, and email address. When linking the service, you explicitly consent to sharing this information with us. You can stop sharing the information from the other service with us by removing our access to that other service.

Payment and Card Information

If you purchase FIXD products or services on our website, you provide your payment information, including your name, credit or debit card number, card expiration date, CVV code, and billing address. We do not store this payment information. This information is transferred securely to PCI Level 1 service providers, such as PayPal, Stripe, Shopify, and Amazon. Note that third-party payment processors may retain this information in accordance with their own privacy policies and terms. We store your name and shipping address in order to fulfill your order. We also store your email address to keep you informed about the fulfillment of your order and information about the payment method you used to help resolve payment disputes.

Information We Receive From Your Use of Our Services

Vehicle Information

To enable our Services, we collect information about the vehicle into which you plug the FIXD Sensor. Examples of the type of information we collect from the vehicle’s onboard computer and sensors include: diagnostic trouble codes, which help explain why the vehicle’s check engine light came on; and data from the mass air flow sensor, which helps us to calculate fuel efficiency. We collect this information to interpret and display to you. We also anonymize and aggregate this data to power predictive algorithms. This will never contain any of your personally identifiable information. These algorithms predict other issues by comparing it to issues detected across other vehicles, so that we can inform you of issues beyond what your vehicle detects. You can stop this collection at any time by removing the FIXD Sensor from the vehicle.

Device Information

When you install the FIXD App, we collect information about the device the application is running on. Examples include the platform, operating system version, manufacturer, and model number. This enables us to detect and resolve application issues.

Language and Locale Information

To enable our Services, we collect information related to your locale, such as your country, preferred language, and currency. This allows us to tailor the application to your preferences. You can change these preferences through the settings menu of the FIXD App.

Location Information

The Services include features that use location data, including GPS signals, Wi-Fi access points, and cell tower IDs. This enables us to detect when you are driving, and to enable location-based features such as maps within the application. On devices running the Android operating system version 6.0 and above, this permission is required to connect to Bluetooth devices such as the FIXD Sensor. Your location data does not leave your mobile device; we do not access, collect, or store it. We do not provide this information to third parties. You opt-in to this functionality by enabling location permissions within the app. You can revoke these permissions at any time by going to the application settings menu of your device.

Usage Information

When you access or use our Services, we receive certain usage data. This includes information about your interaction with the Services, for example, when you view or search content, create or log into your account, pair your device to your account, or interact with your FIXD sensor.When you access the FIXD website, we collect anonymized information about your browsing, such as the pages you visit, the browser you are using, and the way you arrived on the site. We do not store your IP address. This information is not personally identifiable. This information is retained for a maximum of 26 months.

How We Use Information

We use the information we collect for the following purposes.

Provide And Maintain Services

Using the information we collect, we are able to deliver the Services to you and honor our Terms of Service contract with you. For example, we need to use your information to provide you with your FIXD vehicle health report within the FIXD App and to give you customer support.

Improve, Personalize, and Develop the Services

We use the information we collect to improve and personalize the Services and to develop new ones. For example, we use the information to troubleshoot and protect against errors; perform data analysis and testing; conduct research and surveys; and develop new features and Services.

Communicate With You

We use your information when needed to send you Service notifications and respond to you when you contact us. We also use your information to promote new features or products that we think you would be interested in. You can control marketing communications and most Service notifications through the application settings on your mobile device or via the “Unsubscribe” link in an email.

Promote Safety and Security

We use the information we collect to promote the safety and security of the Services, our users, and other parties. For example, we may use the information to authenticate users, facilitate secure payments, protect against fraud and abuse, respond to a legal request or claim, conduct audits, and enforce our terms and policies.

Your Consent

For personal data subject to the GDPR, we rely on several legal bases to process the data. These include when you have given your consent, which you may withdraw at any time using your account settings and other tools; when the processing is necessary to perform a contract with you, like the Terms of Service; and our legitimate business interests, such as in improving, personalizing, and developing the Services, marketing new features or products that may be of interest, and promoting safety and security as described above.

How Information Is Shared

We do not share your personal information except in the limited circumstances described below.

For External Processing

We transfer information to our corporate affiliates, service providers, and other partners who process it for us, based on our instructions, and in compliance with this policy and any other appropriate confidentiality and security measures. These partners provide us with services globally, including for customer support, information technology, payments, sales, marketing, data analysis, research, and surveys.

For Legal Reasons

We may preserve or disclose information about you to comply with a law, regulation, legal process, or governmental request; to assert legal rights or defend against legal claims; or to prevent, detect, or investigate illegal activity, fraud, abuse, violations of our terms, or threats to the security of the Services or the physical safety of any person.

We attempt to notify users about legal demands for their data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague, or lack proper authority, but we do not commit to challenge every demand.

For Aggregated Reporting

We may share non-personal information that is aggregated or de-identified so that it cannot reasonably be used to identify an individual. We may disclose such information publicly and to third parties, for example, in public reports about vehicle age and problems, to partners under agreement with us, or as part of the community benchmarking information we provide to users of our services

Your Rights to Access and Control Your Personal Data

We give you account settings and tools to access and control your personal data, as described below, regardless of where you live. If you live in the European Economic Area, United Kingdom, and Switzerland (the “Designated Countries”), you have a number of legal rights with respect to your information, which you may exercise by contacting us, as outlined below.

Accessing, Editing, and Deleting Data

By using the FIXD App, you can access, and in some cases export, much of your personal information, including information on your account and vehicles. Your account settings let you change and delete much of your personal information. For instance, you can edit the email address we have on file.You have the right to receive an export or deletion of all information we have collected, as well as make edits or updates to certain information. You can request this by contacting privacy@fixdapp.com or our customer support team. Note that while we will make every effort to respond to these requests as soon as possible, it may take up to 3 weeks to complete your request. If you choose to delete your account, please note that while most of your information will be deleted within 7 days, it may take up to 60 days to delete all of your information, such as data stored in our backup systems. This is due to the size and complexity of the systems we use to store data.

Objecting to Data Use

We give you account settings and tools to control our data use. For example, you can limit the notifications you receive from us as described in the Communicating With You section.If you live in a Designated Country, in certain circumstances, you can object to our processing of your information based on our legitimate interests, including as described in the How We Use Information section. You have a general right to object to the use of your information for direct marketing purposes.

Restricting or Limiting Data Use

In addition to the various controls that we offer, if you reside in a Designated Country, you can seek to restrict our processing of your data in certain circumstances. Please note that you can always delete your account at any time.If you need further assistance regarding your rights, please contact our Data Protection Officer at data-protection-office@fixdapp.com, and we will consider your request in accordance with applicable laws. If you reside in a Designated Country, you also have a right to lodge a complaint with your local data protection authority.

Data Retention

We keep your account information, like your name, email address, and password, for as long as your account is in existence because we need it to operate your account. In some cases, when you give us information for a feature of the Services, we delete the data after it is no longer needed for the feature. Unless otherwise specified, we keep other information, like your vehicle diagnostic information, until you request that we delete the data or your account because we use this data to provide you with your vehicle information and other aspects of the Services. We also keep information about you and your use of the Services for as long as necessary for our legitimate business interests, for legal reasons, including as described in the How We Use Information and How Information Is Shared sections.

Our Policies for Children

The Services are not intended for children under 18 years of age, and we do not knowingly collect personal information from children under 18. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us at privacy@fixdapp.com.

Analytics and Advertising Services Provided By Others

We work with partners who provide us with analytics and advertising services. This includes helping us understand how users interact with the Services, serving ads on our behalf across the internet, and measuring the performance of those ads. These companies may use cookies and similar technologies to collect information about your interactions with the Services and other websites and applications.

Google AdWords

When you use the Services or their content, certain third parties may use automatic information collection technologies to collect information about you or your device. In particular, we use Google AdWords remarketing to advertise FIXD and our products and services across the Internet and on third party websites (including Google) to users of the Services. AdWords remarketing will display ads to you based on what parts of the Services you have used by placing a cookie on your mobile device or computing device. It could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. This cookie does not in any way identify you or give us access to your mobile device. The cookie is only used to indicate to websites and other applications that you have used a particular feature of the Services, so that they may show you ads relating to those features. If you do not wish to participate in Google AdWords Remarketing, then you can opt-out by visiting Google’s Ads Preferences Manager at https://adssettings.google.com.

Mediavine Programmatic Advertising (Ver 1.1)

The Website works with Mediavine to manage third-party interest-based advertising appearing on the Website. Mediavine serves content and advertisements when you visit the Website, which may use first and third-party cookies. A cookie is a small text file which is sent to your computer or mobile device (referred to in this policy as a “device”) by the web server so that a website can remember some information about your browsing activity on the Website.

First party cookies are created by the website that you are visiting. A third-party cookie is frequently used in behavioral advertising and analytics and is created by a domain other than the website you are visiting. Third-party cookies, tags, pixels, beacons and other similar technologies (collectively, “Tags”) may be placed on the Website to monitor interaction with advertising content and to target and optimize advertising. Each internet browser has functionality so that you can block both first and third-party cookies and clear your browser’s cache. The “help” feature of the menu bar on most browsers will tell you how to stop accepting new cookies, how to receive notification of new cookies, how to disable existing cookies and how to clear your browser’s cache.For more information about cookies and how to disable them, you can consult the information at All About Cookies.

Without cookies you may not be able to take full advantage of the Website content and features. Please note that rejecting cookies does not mean that you will no longer see ads when you visit our Site. In the event you opt-out, you will still see non-personalized advertisements on the Website.

The Website collects the following data using a cookie when serving personalized ads:

  • IP Address
  • Operating System Type
  • Operating System Version
  • Device Type
  • Language of the website
  • Web browser type
  • Email (in hashed form)

Mediavine Partners (companies listed below with whom Mediavine shares data) may also use this data to link to other end user information the partner has independently collected to deliver targeted advertisements. Mediavine Partners may also separately collect data about end users from other sources, such as advertising IDs or pixels, and link that data to data collected from Mediavine publishers in order to provide interest-based advertising across your online experience, including devices, browsers and apps. This data includes usage data, cookie information, device information, information about interactions between users and advertisements and websites, geolocation data, traffic data, and information about a visitor’s referral source to a particular website. Mediavine Partners may also create unique IDs to create audience segments, which are used to provide targeted advertising.

Information Security

We work hard to keep your data safe. We use a combination of technical, administrative, and physical controls to maintain the security of your data. This includes using Transport Layer Security (“TLS”) to encrypt all of our Services. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the FIXD App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. No method of transmitting or storing data is completely secure. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide. If you have a security-related concern, please contact Customer Support.

Our International Operations and Data Transfers

We operate internationally and transfer information to the United States for the purposes described in this policy.

We rely on multiple legal bases to lawfully transfer personal data around the world. These include your consent, and EU Commission approved model contractual clauses, which require certain privacy and security protections. FIXD Automotive, Inc. is subject to the oversight of the US Federal Trade Commission and remains responsible for personal information that we transfer to others who process it on our behalf as described in the How Information Is Shared section.

Please note that the countries where we operate may have privacy and data protection laws that differ from, and are potentially less protective than, the laws of your country. You agree to this risk when you create an account and click “I agree” to data transfers, irrespective of which country you live in. If you later wish to withdraw your consent, you can delete your account as described in the Your Rights To Access and Control Your Personal Data section.

Changes to this Policy

We may update our privacy policy from time to time. If we make material changes to how we treat our users’ personal information, we will post the new privacy policy on within the Services and an in-App alert the first time you use the FIXD App and the FIXD Website after we make the change.The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address and/or phone number for you and for periodically visiting this privacy policy to check for any changes.
